Terms of Service

1. Acceptance of Terms

By accessing or using LaunchCalibrator (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

LaunchCalibrator provides statistical calibration tools for crowdfunding campaigns and structural risk assessment for startup ideas. Our services include Pre-Launch Calibration, Post-Launch Calibration, the Founder Oracle Kill Test, and the Executive Decision Dossier.

The Service provides analysis based on historical data and pattern matching. It does not predict outcomes, guarantee results, or constitute professional business, financial, or legal advice.

3. No Guarantees or Predictions

LaunchCalibrator provides statistical comparison and structural risk assessment. We explicitly do not:

• Predict the success or failure of any campaign or startup
• Guarantee the accuracy of any analysis or verdict
• Provide investment, financial, or legal advice
• Recommend specific business decisions

Verdicts (PROCEED, ADJUST, STOP) reflect historical pattern analysis, not predictions. A PROCEED verdict does not mean an idea will succeed. A STOP verdict does not mean an idea cannot succeed. All decisions based on our analysis are made at your own risk and discretion.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating an account. You must notify us immediately of any unauthorized use of your account.

5. Payments and Subscriptions

Certain features require payment. Prices are listed on our pricing page and may change with notice. One-time purchases (Solo, Multi-Launch) provide access to the specified number of analyses. Subscription plans (Studio, Agency) renew monthly until canceled.

Payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms of service. Refund requests are handled on a case-by-case basis within 14 days of purchase.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse-engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or use automated means to access the Service beyond normal use
• Submit false, misleading, or malicious data to manipulate analysis results
• Resell or redistribute analysis results as a competing service
• Exceed rate limits or abuse API endpoints

7. Intellectual Property

The Service, including its methodology, algorithms, user interface, and content, is owned by LaunchCalibrator and protected by applicable intellectual property laws. You retain ownership of the data you submit (campaign parameters, idea descriptions).

Analysis results generated for you are licensed to you for your personal or internal business use. You may share your own reports but may not represent them as endorsements by LaunchCalibrator.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

9. Limitation of Liability

To the maximum extent permitted by law, LaunchCalibrator and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Business decisions made based on our analysis
• Lost profits, revenue, or business opportunities
• Inaccuracies in analysis results or verdicts
• Service interruptions or data loss

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that analysis results will be accurate or complete. Historical data is sourced from publicly available information and may contain inaccuracies.

11. Indemnification

You agree to indemnify and hold harmless LaunchCalibrator and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice. You may close your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability and indemnification) will survive.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email to registered users.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
